Welcome to Makerlly! These Terms & Conditions ("Terms") govern your access to and use of makerlly.com and any purchases made through our site. By accessing or using our site, you agree to be bound by these Terms.

1. Account Registration

To place an order, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

2. Product Information & Pricing

We strive to display our products and their colors as accurately as possible. However, we cannot guarantee that your screen's display of any color will be accurate. All product descriptions, images, and prices are subject to change without notice.

If a product is listed at an incorrect price due to a typographical error or pricing error, we reserve the right to cancel any orders placed at the incorrect price, even after an order confirmation has been sent.

3. Orders & Payment

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason, including product availability, errors in pricing or product information, or suspected fraud. Payment is processed at the time the order is placed.

We accept PayPal and major credit cards processed securely through PayPal. Your payment information is not stored on our servers.

4. Shipping & Delivery

We ship to the United States and Canada via ePacket (tracked). Shipping is calculated by weight at checkout. The minimum shipping rate is $5.99 (for orders up to approximately 60g). Heavier orders are charged the actual weight-based rate, displayed before you pay.

Delivery typically takes 7–22 business days. These are estimates only; we are not responsible for delays caused by the carrier or customs. All orders include free tracking. You will receive a tracking number via email once your order ships.

5. Returns & Refunds

We want you to be happy with your purchase. If you are not satisfied, you may return eligible items within 30 days of delivery for a refund.

Return conditions:

• Items must be unused, in original packaging, and in resellable condition.
• Return shipping costs are the customer's responsibility unless the item arrived damaged or incorrect.
• To initiate a return, email us at hello@makerlly.com with your order number.
• Refunds are processed within 14 business days of receiving the returned item, to your original payment method.

6. Intellectual Property

All content on this site — including text, images, logos, graphics, and product photos — is the property of Makerlly or its content suppliers and is protected by United States and international copyright laws. You may not reproduce, distribute, or use any content from this site without our prior written permission.

7. User Conduct

You agree not to use our site for any unlawful purpose or in any way that violates these Terms. You may not attempt to gain unauthorized access to any part of our site, or any system or network connected to our site.

8. Disclaimer of Warranties

Our site and its contents are provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the operation of our site or the accuracy, completeness, or reliability of any content. Your use of our site is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Makerlly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our site or products.

10. Indemnification

You agree to indemnify and hold harmless Makerlly and its owners, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of our site or violation of these Terms.

11. Termination

We reserve the right to terminate or suspend your account and access to our site, at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to our interests or other users.

12. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemic, war, terrorism, labor disputes, supply chain disruptions, or failures of third-party service providers (including shipping carriers).

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. If you are accessing our site from outside the United States, you consent to the jurisdiction of the courts of Delaware for any disputes arising from these Terms or your use of our site.

14. Dispute Resolution

If a dispute arises between you and Makerlly, we encourage you to first contact us at hello@makerlly.com to attempt to resolve the dispute informally within 30 days.

If the dispute cannot be resolved informally, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Judgment on the arbitration award may be entered in any court having jurisdiction. This agreement to arbitrate does not preclude you from seeking action in a small claims court for disputes within its jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. California Residents

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of our site after any changes constitutes your acceptance of the new Terms.
